Surveillance technology supplier Datong has not infringed a competitor’s patent and the costs of the litigation will be less than the £300,000 provision made in 2009. 

This is some good news following disappointing trading statements at the end of 2011. The shares rose 4p to 28.5p a share, which values Datong at £3.94m.

The court proceedings have been going on since 2006. In March 2009, the original judgement in the High Court was in favour of MMI Research, which alleged that a third party product sold by Datong infringed a UK patent jointly held by MMI. The Court of Appeal has judged that the patent is invalid.

No damages are payable but the court has not ruled on who will pay costs. Even if Datong has to pay its share of the costs it will still be much lower than £300,000.
